Terms and Conditions
§ 1 GENERAL PROVISIONS
- The getFindia application is owned by Picado sp. z o.o., Floriana Stablewskiego 47 lok. 4, 60-213 Poznań, Poland, Tax Number PL7822575026, KRS 0000549874
- The administrator of the personal data collected within the application is Picado sp. z o.o.
- Users of the application are required to comply with the provisions of these Terms and Conditions.
§ 2 REGISTRATION
- A registered user of the getFindia application can be any person who, after accepting the provisions of the Terms and Conditions, successfully completes the registration procedure in the getFindia application and creates an account.
- Registration is required to use the getFindia application.
- The user installs the application via Facebook or through an online store offering the application, consenting to the processing of their personal data during the installation process. As part of the integration of the application with the user’s Facebook account, the application gains access to the user’s Facebook ID and profile picture. The application stores only the user’s Facebook ID and profile picture. Other data remains on Facebook and is not stored in the application or shared with the administrator. Additionally, Picado sp. z o.o. stores the email addresses of application users in case users need to contact Picado sp. z o.o. via the contact form in the “Contact” section of the application’s website.
- The user is required to provide true data (i.e., a valid email address).
- By registering in the getFindia application, the user consents to the processing of their personal data for the purpose of using the application and for statistical purposes.
§ 3 TERMS OF USE OF THE GETFINDIA APPLICATION
- The getFindia application is available for mobile devices with Android and iOS systems in accordance with the specifications provided by the distribution services.
- Using the application requires enabling GPS location services and data transfer on the mobile device. This is necessary for the proper functioning of the application.
- To solve a Place in the getFindia application, the user must visit the location indicated in the Place.
- Detailed instructions for using the getFindia application are displayed after the application is installed on the mobile device and are available in the application’s menu.
§ 4 USER RESPONSIBILITY
- Copyright. Copying and publishing any content from the getFindia application in other media, especially on other websites, in printed publications, multimedia presentations, training materials, and any other documents without the owner’s consent is prohibited.
- Picado sp. z o.o. owns all content, photos, and graphics posted in the application.
- Unless otherwise provided in separate licensing or promotional agreements, the owner of the application does not authorize the following:
a) Licensing or selling Places contained in the getFindia application;
b) Using Places for purposes other than non-commercial personal use;
c) Modifying, changing, or creating derivative works based on Places contained in the getFindia application. - Failure to comply with these rules will result in a request for immediate removal of the copyright violation and the suspension of the user’s account in the application.
§ 5 LICENSE TO USE THE GETFINDIA APPLICATION
- Subject to the terms set forth in these Terms and Conditions, the user receives a non-transferable, non-exclusive license to install and use copies of the application solely for non-commercial purposes. Any updates that supplement or replace a given version of the application are also subject to the provisions of these Terms and Conditions unless a special license is issued for these updates, supplements, or replacements.
- The owner of the application does not authorize or permit any third party to:
- a) License or sell the getFindia application;
- b) Distribute the application, except where such distribution is expressly authorized by the owner;
- c) Use the getFindia application for purposes other than personal, non-commercial use;
- d) Modify, change, or create derivative works based on the getFindia application.
§ 6 DATA PROTECTION
- The administrator of personal data ensures that users of the application have the rights granted by the Personal Data Protection Act, including the right to access their personal data and correct it, as well as the right to control the processing of their personal data as described in the act.
- The user has the right to access, modify, or revoke their consent to the processing of personal data at any time without providing a reason. Revoking consent for the processing of personal data for the purpose of providing services through the application or for marketing purposes can be done by sending an email to: biuro@getfindia.com and may result in limiting or preventing the user from using the application.
- The user consents separately to the processing of personal data for marketing purposes, and this consent can be revoked independently of consent for the processing of personal data for the provision of services via the application.
- The user can disable location services at any time through the appropriate option in the mobile device’s system settings, but this may limit or prevent the user from using the application while location services are disabled.
- The personal data of application users may be shared with entities authorized to receive them under applicable law, including law enforcement agencies.
- The personal data of application users may be entrusted to contractors, subcontractors, or other entities cooperating with the administrator under a data processing agreement.
- The personal data of users is protected by the data administrator from unauthorized access, disclosure, loss, and unauthorized modification through appropriate organizational and technical security measures, including encryption systems.
§ 7 COOKIES
- Picado sp. z o.o. declares that it uses a cookies mechanism, which by saving short text information on the user’s computer or other person visiting the website, allows identification for the purpose of improving site usability, enabling login, and cooperating with applications provided by Google Inc. and Facebook.
- Accepting cookies on the user’s computer is necessary to provide the IT service. Any person visiting the website can prevent cookies from being saved on their computer or permanently delete them by modifying their browser settings. Allowing the browser to save cookies on the computer simultaneously gives consent to this saving. The service provider ensures that saving cookies on the user’s computer does not cause any configuration changes to the computer or software.
§ 8 FINAL PROVISIONS
In matters not regulated by these Terms and Conditions, the provisions of Polish law, in particular, the Civil Code and the Copyright Act, shall apply.
The administrator reserves the right to change Picado sp. z o.o.’s Privacy Policy at any time. The new Privacy Policy takes effect upon publication on the website.
Privacy Policy
Statistics and advertising. The getFindia website uses external services to collect statistical data on how users use its websites and applications, including services provided by Microsoft. Additionally, these data are used for site optimization, security/fraud prevention, and advertising purposes. DATA PROCESSING INFORMATION CLAUSE
In compliance with the requirements of the European Parliament and Council Regulation (EU) 2016/679 of April 27, 2016, regarding the protection of individuals concerning the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation “GDPR”), we inform you about the principles of processing your personal data and your rights in this regard.

- The administrator processes your personal data based on applicable legal provisions, concluded contracts, and consent provided by you.
- Your personal data is processed for the following purposes:
a) The person concerned has given consent for one or more specified purposes – e.g., if you have opted to receive our newsletter.
b) Processing is necessary for the performance of a contract to which the data subject is a party – e.g., if you create content in our application.
c) Processing is necessary for compliance with a legal obligation to which the administrator is subject. - Your personal data may be shared with public authorities or entities performing public tasks or acting on behalf of public authorities, or other entities that process personal data based on relevant agreements.
- Your personal data will be stored for the period necessary to achieve the purposes specified above, and after that, for the period required by law.

- The right to rectify data – if the data is incorrect or incomplete
- The right to request the deletion of personal data (the “right to be forgotten”)

- If the processing of personal data is based on consent (Article 6(1)(a) of the GDPR), you have the right to withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.
- If you become aware of unlawful processing of your personal data, you have the right to lodge a complaint with the supervisory authority responsible for personal data protection.
- If the processing of personal data is based on consent, providing your data to the administrator is voluntary.
- Providing personal data is mandatory if processing is required by law or contract.
- Your data may be processed automatically but will not be subject to profiling.
- Your personal data will not be transferred to a third country or an international organization.
